PS PROP, operated by Preps Development Co., Ltd. (the “Company”), thanks every user for visiting our website. So that you may understand and accept the terms governing use of the service, the Company sets out the following terms and conditions of use.
1. What this website provides
The website compiles and publishes real estate listings for both sale and lease, together with brokerage and agency services provided by PS PROP itself. We provide services in two capacities, which carry different responsibilities:
where another person posts their own property listing, we act as the provider of the listing space and are not a party to the sale or lease between you and the advertiser;
where we act as broker directly for the property owner, the rights and obligations shall be governed by the brokerage agreement prepared separately on a case-by-case basis.
2. Acceptance and amendment of the agreement
Accessing the website is deemed to constitute your having read, understood and accepted this Agreement. If you do not accept any provision hereof, please discontinue use.
We may amend this Agreement from time to time by publishing the amended version on this page, stating the effective date at least 7 days in advance.
3. Use of the website
You agree to use the website for lawful purposes only, and shall not commit any act that interferes with the operation of the system, nor use any automated program to breach, copy, or access the database system or the accounts of other persons from the website, without written consent.
Where an infringement occurs that may cause serious damage or that is unlawful, the Company will immediately take legal action against the infringing party and will immediately suspend access without prior notice.
Should you disagree with a suspension, you may submit an objection within 15 days; we will consider the matter and respond within 15 business days.
4. User accounts
The information you provide upon registration and when posting a listing must be accurate and current. We may suspend any account that has provided false information.
Users are responsible for keeping their password confidential and are liable for all activity occurring under their account. Should any irregular use be detected, please notify the Company immediately.
5. Information on the website is for preliminary decision-making
It does not constitute a formal offer for sale, a valuation, or investment advice. Please inspect the condition of the property and its title documents yourself before making any decision.
The same applies to the commission figures displayed on the website: these are estimates for reference only. The binding terms shall be those of the written contract made between the Company and the user on a case-by-case basis.
6. Intellectual property
All text, images, graphics, video, trademarks, logos, icons, software, source code and databases appearing on the website are protected under intellectual property law as property of the Company. They may be viewed for the purpose of personal consideration of properties, but may not be reproduced, adapted, copied or further disseminated for commercial exploitation or improper benefit without written permission. Should any infringement occur, we reserve the right to claim damages under the law.
7. Links to other websites
Our website displays advertising and contains links to other websites of interest belonging to third parties. Should you follow a link to another website, please note that we shall not be responsible for the privacy policy of that website, and we recommend that you read the privacy policy of each website when visiting it.
8. Limitation of liability
The Company endeavours to maintain the accuracy of the information on the website, but does not warrant the completeness or currency of listing information prepared by users, and such information shall not give rise to any legal right and/or obligation in any case whatsoever. The Company shall further not be liable for indirect or consequential damage arising from use of the website, or damage arising from force majeure, save where the law provides otherwise.
9. Governing law
This Agreement is governed by Thai law, and any dispute arising shall fall within the jurisdiction of the Thai courts.
